Acceptance of Terms

By accessing or using AILandscape, you agree to these Terms of Service. If you do not agree, do not use the service.

Description and Availability of Service

AILandscape provides AI-assisted landscape visualization software. Features may be modified, suspended, limited, blocked, or unavailable. Product pages, account entitlements, and the service interface determine what is currently offered; descriptions of planned, blocked, or unavailable capabilities are not commitments to deliver them.

Direct sharing, professional plans, PDF export, version history, fixed retention periods, and other capability-gated features may be blocked or unavailable unless the service expressly enables them for your account.

Visualization Only; No Professional Advice

AI output is a conceptual visualization, not professional construction, architectural, engineering, horticultural, landscaping, cost, code, permitting, accessibility, environmental, irrigation, electrical, structural, pool, fire, or safety advice. It is not a certified plan, measured drawing, contractor quote, plant-suitability determination, or guarantee that a design can or should be built.

Outputs may be inaccurate, incomplete, impractical, unsafe, or inconsistent with your property and local conditions. You are responsible for verifying measurements, utilities, drainage, soil, climate, plant toxicity and suitability, property boundaries, codes, permits, costs, constructability, and safety with qualified professionals before acting on an output.

Uploaded Content and Permissions

You retain the rights you hold in content you upload. You represent that you have the rights and permissions needed to upload and process it, and that it does not violate law or another person's rights.

You grant us and our service providers a limited license to host, copy, transmit, process, modify, and display uploaded content and generated results as needed to operate, secure, and support the service.

Designs are private by default. If you separately select the optional Gallery consent, you apply for public display of the original photo and generated result as a before-and-after presentation. Admin approval is required, publication is not guaranteed, and Gallery consent does not authorize direct sharing, case-study use, unrelated marketing, or model-training use.

AI Providers and Sensitive Content

Operation of the service may require sending uploaded content and instructions to third-party AI and infrastructure providers. Provider model-training terms, EXIF removal, asset retention periods, and deletion timing have not been fully verified or technically guaranteed. Do not upload sensitive or confidential images if these limitations are unacceptable to you.

User Accounts and Acceptable Use

You are responsible for account security and activity under your account. You must not use the service unlawfully; infringe rights; upload content without permission; attempt unauthorized access; disrupt the service; evade safeguards; or submit malicious, deceptive, or harmful content.

Payment, Credits, and Refunds

Prices, currencies, credit costs, purchased-credit validity, and enabled capabilities are those shown by the service at the time of purchase or use. Do not rely on blocked, planned, or unavailable features when purchasing. Except where law requires otherwise or an applicable displayed policy states otherwise, purchases and credit adjustments are handled under the policies presented by the service and reviewed case by case.

Intellectual Property

The service, excluding user content, is owned by us or our licensors and is protected by applicable intellectual-property laws. These Terms do not transfer ownership of the service or third-party materials.

Termination

We may suspend or terminate access for violations, risk, abuse, nonpayment, or legal requirements. You may stop using the service or close your account through available controls. Termination does not create a guaranteed asset-deletion deadline.

Disclaimers and Limitation of Liability

The service and AI outputs are provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee accuracy, availability, fitness for a particular purpose, professional suitability, or specific results.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the service or reliance on AI output. Nothing in these Terms excludes liability that cannot legally be excluded.

Changes to These Terms

We may update these Terms. We will update the date above and provide additional notice when required by law. Continued use after an effective update constitutes acceptance where permitted by law.
